This Privacy Policy notice describes how Tier One Partners, LLC (collectively with its affiliates, “Tier One” “we“, “our” or “us“) handles and protects the information it collects or receives from the users (“users” or “you“) of its website at www.tieronepr.com (the “Site”).

INFORMATION WE COLLECT

Tier One collects information from users visiting the Site. This information includes traffic data including a user’s IP address, domain server, type of computer, and type of web browser. We track users’ movements around the Site. Some areas of our Site require you to register and provide your name and contact information. Downloading our software products requires you to register and provide your name, contact information, and intended use case. We collect personal information, such as a user’s name, address, contact information and other personally-identifiable information (“Personal Information” or “PII”) when you register on the Site, request a demo, request a download, or otherwise interact with us (for example through the “contact us” option). We collect statistical data related to our users’ use of the Site (including Site usage patterns), our software products and our services. You have no obligation to provide us with any PII and the submission of such information is at your sole discretion and consent. However, if you will not provide us with the required information, we may be unable to provide you with the information, downloads, or services you requested.

HOW WE USE INFORMATION

We use the information we collect to analyze trends, to administer the Site, and improve our products and services, for marketing purposes, for improving users’ experience on the Site, and to gather demographic information about our user base. We may use the information that you provided us or that we collected from your activity on the Site in combination with PII from other sources and use third-party services to infer your region and the organization you are associated with to tailor the content you see, interact with you, and market directly to you. We compile and store data and information and generate reports related to our users’ access to and use of our Site and products and services. We may share aggregated statistical information with third parties. We do not disclose, sell, or provide your PII to third parties, except in the following circumstances:

  • If the information is required by law in order to prevent, investigate, or take action regarding illegal activities. In addition, we will share information in response to legal process, court orders, subpoenas, or to establish or exercise our legal rights or defend against legal claims;
  • For the purpose of providing you with products and/or services you request and operating the Site we may share PII with trusted third-party partners who need to have access to the information for the purpose of providing Site-related services to us only (and not for such third parties’ commercial use in any way).
  • If we have your permission to do so.
  • Information collected from users of the Site, including PII, could be transferred as part of or in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our stock and/or assets relating to the business conducted through the Site or other corporate change, including, during the course of any due diligence process.

By submitting your PII through the Site or otherwise providing it to us, you agree that your information may be transferred to third parties under the circumstances described above or similar circumstances.

COOKIES

A cookie is a piece of data stored on a user’s hard drive containing information about the user. We use cookies to enhance the user experience of our Site (such as storing password or user preference information). If a user rejects the cookie, they may still use our Site with the only drawback being the disablement of some of the usability features of our Site. We also use cookies (including allowing third-party cookies) to track and monitor usage of the Site by users for the purposes of marketing, Site improvement, and retargeting ads to you when you visit other sites. Most browsers will allow you to erase cookies from your computer hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. Many ad networks have joined the Digital Advertising Alliance’s self-regulatory program to provide a single opt-out tool at: http://www.aboutads.info and at the European Interactive Digital Advertising Alliance (EDAA) website: http://youronlinechoices.eu. However, Tier One does not guarantee that using these tools will prevent online behavioral tracking using cookies through the Site. At present, Tier One does not honor Do Not Track signals set by some browsers. If you wish to avoid behavioral tracking by ad networks, please choose from the available methods for doing so.

E-MAIL COMMUNICATIONS

At any time, you can opt out of receiving marketing communications from Tier One, but you may not opt out of administrative emails (for example, emails about your transactions or policy changes) while you are a registered user. You can opt out by contacting support@tieronepr. We do not send marketing emails to you if you decide to opt out, and we do not sell or provide email addresses to any third party, except in the situations stated above.

POLICY TOWARDS CHILDREN

We do not knowingly collect PII from children under the age of 16. If a parent or guardian becomes aware that his or her child has provided us with PII without his or her consent, he or she should contact us at support@tieronepr.com. If we become aware that a child under the age of 16 has provided us with PII, we will delete such information from our files.

YOUR CALIFORNIA PRIVACY RIGHTS

Under California’s “Shine the Light” law, California residents who provide certain personally identifiable information in connection with obtaining products or services for personal, family, or household use are entitled to request and obtain from us (once per calendar year) information about the customer information that we shared (if any) with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year.

To obtain this information, please send an email message to support@tieronepr.com with “Request for California Privacy Information” in the subject line and in the body of your message. We will provide the requested information to you at your email address in response. Please be aware that not all information sharing is covered by the “Shine the Light” requirements, and only information on covered sharing will be included in our response.

SECURITY

We employ commercially reasonable security measures to protect the PII submitted to us, both during transmission and once we receive it. However, due to the nature of Internet communications and evolving technologies, the security of user information may be compromised at any time through unauthorized entry or use, hardware or software failure, and other causes. No method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee the absolute security of PII and disclaim any assurance that such information will remain free from loss, misuse, or alteration by third parties who, despite our efforts, obtain unauthorized access.

CHANGES AND CONSENT TO PRIVACY POLICY

By registering with Tier One or by using the Site without prior registration, you agree to the terms of this Privacy Policy. We reserve the right to change the provisions of the Privacy Policy from time to time without prior notice and you are therefore advised to check it regularly. Your continued use of the Site after any change to the Privacy Policy constitutes your acceptance of this Privacy Policy as revised. LINKS Our Site may have links to the sites of other companies. We are not responsible for their privacy practices. We encourage you to learn about the privacy policies of those companies.

UPDATE/DELETE USER INFORMATION

To request access to or deletion of your information, it is best to follow the unsubscribe link at the bottom of the emails you receive from Tier One. You can also write to us at any time to obtain a copy of your information and to have any inaccuracies corrected or if you no longer desire our service (in which case we will endeavor to remove your PII provided to us). Where appropriate, you may have your PII erased, rectified, amended or completed. In order to contact us regarding your information please e-mail support@tieronepr.com. To protect your privacy and security, we may take reasonable steps to verify your identity before granting access or making corrections, however, you should protect your password from disclosure because anyone who gains access to your password may have access to, and may edit, your profile. While we try to comply with any request pertaining to your PII, in accordance with applicable law, we may not be able to fulfill requests pertaining to information already shared with third parties. Some information may be retained on our systems in accordance with our record keeping policies, and some residual digital information cannot be removed or changed.

GOVERNING LAW

Any and all legal claims, suits or actions that arise in connection with this Privacy Policy or with breach of this Privacy Policy shall be submitted to the personal jurisdiction of the state and federal courts located in the county of Suffolk in the Commonwealth of Massachusetts.
